GAFFNEY, SC (WSPA) – The family of a volunteer with Black horse antiques that died after falling down an elevator shaft in November of 2015, is suing the business, their owners, and the city.
Rae Gilmore fell into the basement of the building while the freight elevator was on the 2nd floor, according to coroner Dennis Fowler.
Gilmore was a volunteer and sold her own items at the antique store on East Fredrick Street.
The lawsuit alleges that the elevator in the antique store was permitted, even though it was unsafe and that Gilmore was never informed of its dangers.
The lawsuit also claims that the elevator was not inspected and maintained to remedy problems with the elevator.
The lawsuit says that Gaffney did not notify the South Carolina Department of Labor, Licensing and Regulation that the elevator even existed in the building.
The estate of Gilmore is suing the city of Gaffney, Black Horse Antiques, and the company that owns the building.
