Alarm raised after woman spotted drink-driving 'erratically'

A PERSON raised the alarm after seeing a car being driven erratically and they spoke to the driver who he said was drunk.

Blackburn magistrates heard when police got to the home of Rachel Louise Pemberton she initially claimed she had been in bed asleep but she was fully clothed and wearing shoes and the officers could also see she was drunk.

Pemberton, 31, of Whalley Road, Billington, pleaded guilty to failing to provide a specimen for analysis.

She was banned from driving for three years, made subject to a community order for 12 months with 200 hours unpaid work and ordered to pay £85 costs and £30 victim surcharge.

Glen Anderton, prosecuting, said a motorcyclist saw Pemberton driving near the Spice Lounge restaurant.

She was driving slowly and crossing the road repeatedly. He flashed his lights and she stopped and it was clear she was drunk.

"She then did a u-turn and set off again despite having a completely flat tyre," said Mr Anderton.

Pemberton gave a roadside breathalyser reading of 102 against the legal limit of 35.

At the police station Pemberton, who had a excess alcohol conviction in 2013, refused to provide a sample.

Jonathan Taylor, defending, said Pemberton had been at a pub with her partner and had no intention of driving that night.

"There was an argument and she left and, without thinking, got in her car," said Mr Taylor.

"She was upset and emotional and made a bad decision."
