Tye man indicted after allegedly ‘slamming’ wife legs with car door

By Timothy Chipp[1] of the Abilene Reporter News

A Taylor County grand jury on Thursday indicted a Tye man suspected of slamming a car door on his wife's legs.

Nicholas Scott Powell, 38, is charged with enhanced third-degree felony assault family violence after police said he attacked his wife in the couple's home Feb. 25.

According to court documents, Powell and his wife were running errands in their vehicle when they ran out of gas.

Upon returning to their residence, Nicholas thought his wife was upset about running out of fuel, according to the documents, and he became angry. She told him to leave her alone and went to the bathroom and shut the door, documents said.

He then broke the door down, according to the documents, and began pushing her and yelling at her. She reportedly pushed him back and left the apartment to retrieve items from their vehicle.

He followed her outside and, while she was sitting in the passenger seat with the door open, he allegedly slammed the door, catching her legs in its path.

Officials said Powell's charge was enhanced because he previously was convicted of assaulting a family member in January 2007.

Powell was being held in the Taylor County Jail in lieu of a $10,000 bail bond, according to jail records.
